What is an Emancipation Petition?
An emancipation petition is a request for the court to have the
child treated as an adult. This relieves the parents of supporting the minor
and being liable for the actions of the minor. Additionally, the
minor may do certain things normally reserved for adults. If
needed, we will represent parents in these proceedings.
Who may file an Emancipation Petition?
Any youth, at least 16 years of age but not yet 18 years of age,
or the parents of the youth, may file an Emancipation Petition.
Is DCF involved in an Emancipation?
Not in the filing of an Emancipation Petition. However, the
court may ask DCF to review the matter and present its findings
to the Judge.
When will the Court grant the Emancipation?
The Court will usually grant emancipation if it is satisfied
that: the minor is willingly living apart from the parents or
guardians, is capable of managing his or her own affairs, and is
in fact managing those affairs satisfactorily.
